What is a Wrongful Death claim in Colorado?
In general, the term wrongful death refers to when a person dies as the result of the negligence (carelessness) of another, then that victim is said to have suffered a wrongful death. The surviving family members or the estate of the deceased has the right to pursue a wrongful death claim.
Colorado Statutes section 71.001 defines wrongful death as one party’s “wrongful act, neglect, carelessness, unskillfulness, or default” causing the death of another. Negligence is conduct for which victims can be paid when injured or killed by a person that falls short of what a reasonable person would have done to prevent the circumstances from occurring.
